TÜRK BORÇLAR KANUNU MADDE 417 BAĞLAMINDA İŞÇİNİN KİŞİLİĞİNİN KORUNMASI

چکیده
Çalışmada, işçinin Türk Borçlar Kanunu bağlamında kişiliğinin korunması meselesi ele alınmıştır. İktisadi gelişmenin en önemli toplumsal konuyu teşkil ettiği 19-20. yy dönemlerinin geride kalmasıyla; günümüz dünyasında ekonomik sistem içinde bireysel alanının giderek daha gerekli ve bir konu haline gelmiştir. Zira sistemin temel yapıtaşı olan işçiler, yalnızca yönlerden değil; birey olarak kişilik hakları bakımından da korunmaya ihtiyaç duymaktadırlar. Bu bağlamda; hukuk dünyasındaki güncel gelişmeler neticesinde kavramlaşan yeni nesil haklar da; korunmasında ayrıcalıklı konuma sahip olmaktadır. 
 İşçinin konusu; Anayasa, Medeni Kanunu, Kanunu’nda yer verilen çeşitli hükümler üzerinden hukuki dayanaklarına kavuşmaktadır. Ayrıca İş düzenlenen işverenin işçilere eşit davranma borcu (İş K. m. 5); korunmasına hizmet etmesi sebebiyle alınmıştır.
 TBK 417 kişiliğini genel özel yönleriyle korumaktadır. Genel yönden yukarıda değinilen mevzuat çerçevesinde geniş anlamda koruma düzenlenmişken, psikolojik taciz cinsel tacize karşı üzerinde özellikle durulmuştur. bağlamda çalışmada anılan bu kavramlar alınarak konunun derinlemesine alınması amaçlanmıştır.
